Acceptance of Terms

These Terms and Conditions (the “Terms”) govern your use of waterdamagerestorationtampafl.com and any matching, referral, or scheduling services offered by Tampa Water Damage Restoration. By accessing the site, requesting an estimate, submitting your information, or engaging providers matched through Tampa Water Damage Restoration, you agree to these Terms. If you use these services on behalf of another person or entity, you represent that you are authorized to do so and accept these Terms for that party as well.

You must be at least 18 years old to use the site or request services. If you do not agree with these Terms, do not use the site or the services.

Description of Services

Tampa Water Damage Restoration operates as a local lead-generation and coordination service that connects homeowners, renters, property managers, HOAs, and condo associations with independent, third‑party contractors (the “Pros”). Offerings may include water damage restoration, mold remediation, and condo water damage restoration.

Tampa Water Damage Restoration is not a licensed contractor and does not itself perform restoration, remediation, or repair work. Any work is provided solely by the Pros with whom you choose to contract. Tampa Water Damage Restoration does not supervise, control, or guarantee the Pros’ work, pricing, schedules, permits, or compliance. You are responsible for reviewing any Pro’s qualifications, licenses, insurance, and proposal before authorizing work.

Service Area and Availability

Service matching is focused on Tampa, FL and nearby communities, including Tampa, FL, Brandon, FL, Riverview, FL, Clearwater, FL, and Spring Hill, FL. Availability may vary by Pro and project scope.

Office hours are Monday through Sunday, 9 AM – 9 PM local time. During office hours, general inquiries may be directed to (656) 248-4007. Pros may maintain separate schedules, fees, and lead times. No guarantee of immediate or same‑day service is made.

User Obligations

You agree to provide accurate, current information about your property, water source, moisture conditions, and any known hazards. You will ensure safe access to the work area, secure pets and valuables, disclose known risks (including utilities and asbestos‑containing materials), and follow building, HOA, and condo rules.

You are responsible for obtaining all necessary permissions to authorize work at the service address, including consent from owners, tenants, HOAs, and property managers. You agree not to misuse the site, attempt to interfere with its operation, or submit unlawful, infringing, or misleading content.

Estimates, Scheduling, and Payment

Requests for service may result in matches with one or more Pros. Any estimate is prepared by the Pro and may change after an on‑site assessment, moisture readings, or scope revisions. Final pricing, timelines, materials, and warranty terms are set by the Pro you choose.

You will pay the Pro directly under the Pro’s contract and payment policies. Tampa Water Damage Restoration may receive a marketing or referral fee from a Pro at no additional cost to you. Taxes, permits, parking, after‑hours fees (if any), and change orders are your responsibility unless otherwise agreed in writing with the Pro. Cancellations and rescheduling are subject to the Pro’s policies and any applicable charges.

Insurance, Authorizations, and Condo Work

Insurance claims, coverage decisions, and payments are solely between you and your insurer. Tampa Water Damage Restoration is not a party to insurance claims and does not guarantee claim approval, scope, or pricing. You remain responsible for all amounts not paid by insurance, including deductibles.

Condo projects often require prior approvals, coordination with building management, and adherence to rules for access, elevators, parking, and noise. You agree to obtain necessary approvals and share relevant requirements with the Pro before work begins.

No Professional Advice

Materials on the site are for general information only and are not legal, insurance, engineering, or environmental advice. Decisions about water damage restoration, mold remediation, or repairs should be made with qualified professionals who have assessed your property.

Independent Pros; No Warranty by Tampa Water Damage Restoration

Pros operate independently and are not employees, agents, or partners of Tampa Water Damage Restoration. Tampa Water Damage Restoration does not warrant the quality, safety, licensing, insurance, pricing, availability, or results of any Pro.

TO THE FULLEST EXTENT PERMITTED BY LAW, Tampa Water Damage Restoration PROVIDES THE SITE AND MATCHING SERVICES “AS IS” AND DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. Any warranties for labor or materials are provided solely by the Pro, if offered.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Tampa Water Damage Restoration WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, PROPERTY DAMAGE, PERSONAL INJURY, BUSINESS INTERRUPTION, OR COST OF SUBSTITUTE SERVICES, ARISING FROM OR RELATED TO THE SITE, MATCHING SERVICES, OR WORK PERFORMED BY PROS.

IN ALL EVENTS, Tampa Water Damage Restoration’S TOTAL LIABILITY FOR ANY CLAIMS WILL NOT EXCEED THE GREATER OF: (A) ONE HUNDRED DOLLARS ($100), OR (B) THE AMOUNT YOU PAID TO Tampa Water Damage Restoration FOR THE MATCHING SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (EXCLUDING AMOUNTS PAID TO ANY PRO). SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OF LIABILITY; IN SUCH CASES, THESE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED.

Indemnification

You agree to defend, indemnify, and hold harmless Tampa Water Damage Restoration and its affiliates, owners, and representatives from and against all claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the site or services; (b) your contract or interactions with any Pro; (c) property access or conditions at the service address; (d) your breach of these Terms; or (e) your violation of laws or third‑party rights.

Intellectual Property

All content on the site - including text, graphics, logos, icons, and software... is owned by or licensed to Tampa Water Damage Restoration and protected by intellectual property laws. You may not copy, distribute, modify, reverse engineer, or create derivative works from the site or its content except as permitted by law or with prior written consent from Tampa Water Damage Restoration.

Privacy and Communications

When you submit your information, you consent to Tampa Water Damage Restoration sharing it with matched Pros for service coordination, pricing, and scheduling. You agree that Tampa Water Damage Restoration and Pros may contact you by phone, text message, or email about your request, project updates, and related services. Message and data rates may apply. Severability; Waiver; Assignment; Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force. Failure to enforce a provision is not a waiver of the right to do so later.
